These Terms & Conditions ("Terms") are a legal agreement between you and Paypixl, Inc., a Delaware corporation ("Paypixl," "we," "us," or "our"), governing your use of the StormView mobile application, the website at weather.stormview.io, and related services (together, the "Service").

PLEASE READ SECTIONS 9–12 CAREFULLY. THEY DESCRIBE THE NATURE AND LIMITS OF THE REPORTS, DISCLAIM WARRANTIES, LIMIT OUR LIABILITY, AND REQUIRE INDIVIDUAL ARBITRATION AND A CLASS-ACTION WAIVER.

By creating an account, checking a box indicating your acceptance, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement of a parent or legal guardian. If you use the Service on behalf of a company or other entity, you represent that you are authorized to bind that entity to these Terms.

2. Your account

You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your login credentials, and for all activity under your account. Notify us promptly at support@paypixl.io of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

3. The Service

StormView produces forensic weather reports — including "Storm Snapshot" (Quick-Look) event histories and "Detailed Analysis" reports — for property addresses you submit. Reports draw on public and third-party data sources (for example, National Weather Service records, NEXRAD radar, storm-event databases, and property/parcel data) and present data-strength assessments of whether weather conditions consistent with property-damaging hazards were present near a location during a time window. Optionally, a certified meteorologist may review, annotate, and certify a Detailed Analysis.

4. Orders, pricing, and payment

• Prices are shown in the Service before purchase and may change from time to time.
• Payments are processed by our third-party payment processor (Stripe). By purchasing, you authorize us and our processor to charge your selected payment method. You agree to Stripe's terms in addition to these Terms.
• Where a purchase is made through the Apple App Store, that transaction is processed by Apple and is also subject to Apple's applicable terms.
• You are responsible for any taxes associated with your purchases, unless we are required to collect them.

5. Subscriptions and renewals

If you purchase a subscription plan, it continues and, where applicable, renews automatically for successive periods at the then-current price until you cancel. You may cancel at any time, and cancellation stops future renewals. Cancellation takes effect at the end of the current billing period; you retain access through that period. If you subscribe through the Apple App Store, you manage and cancel the subscription through your Apple account settings, and Apple's auto-renewal rules apply.

6. Refunds

All sales are final. Reports are non-refundable once generated or delivered, because they are produced on demand for your specific request. Subscription fees already charged are non-refundable, including for the current period upon cancellation, except where a refund is required by applicable law or, for App Store purchases, granted by Apple under its policies.

7. Report modifications

For a given report/order, you may change the date range and re-run the analysis for the same property as often as you wish at no additional charge. Additional properties or new reports are separate purchases.

8. Acceptable use

You agree not to: (a) use the Service unlawfully or to infringe others' rights; (b) submit addresses or data you have no right to submit; (c) reverse engineer, scrape, overload, or interfere with the Service or its security; (d) resell or redistribute reports as a competing data product; or (e) use the Service to harass, defraud, or harm others. You are responsible for your use of report outputs.

9. Nature of the reports — important disclaimer

READ THIS CAREFULLY. StormView reports are data-driven plausibility and consistency assessments, not confirmations of fact. Specifically:

• A report indicating that conditions were consistent with a damaging hazard is not a determination that damage occurred, that a hazard actually reached a specific structure, or that any particular loss was caused by weather.
• Radar and modeled data do not independently confirm damage at a structure.
• Unless a report has been expressly certified by a licensed meteorologist through the Service, its conclusions are UNVERIFIED and are generated by automated analysis.
• Reports are not a substitute for professional meteorological, engineering, legal, insurance-adjusting, or other expert judgment, and should not be the sole basis for any insurance, legal, financial, safety, or property decision.
• Underlying data comes from third-party and public sources that may be incomplete, delayed, or inaccurate, and which we do not control.

You are solely responsible for how you interpret and use reports, including any use in claims, litigation, or other proceedings.

10. Disclaimer of warranties

THE SERVICE AND ALL REPORTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY REGARDING ACCURACY, COMPLETENESS, RELIABILITY, OR AVAILABILITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT REPORTS WILL BE ACCURATE OR SUFFICIENT FOR ANY PURPOSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAYPIXL AND ITS OFFICERS, EMPLOYEES, CONTRACTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSSES ARISING FROM YOUR RELIANCE ON ANY REPORT, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE EVENT, OR (B) US $100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

12. Indemnification

You agree to indemnify and hold harmless Paypixl and its personnel from claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your report inputs, your violation of these Terms, or your use of report outputs in any proceeding or decision.

13. Intellectual property; your content; license

• The Service, software, and StormView brand are owned by Paypixl and protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service and the reports you purchase for your own business or personal use, subject to these Terms.
• You retain rights to the inputs you submit (e.g., addresses). You grant us a license to use those inputs to provide, operate, secure, and improve the Service.
• Share links you create allow anyone with the link to view the associated report until you revoke the link.

14. Third-party services

The Service integrates third-party services (including Stripe, Google, Mapbox, Resend, our SMS provider, DigitalOcean, Expo, and Apple). Your use of those features may be subject to the third parties' terms, and we are not responsible for third-party services or data sources.

15. Apple App Store — additional terms

If you obtained the app from the Apple App Store, the following apply and Apple is a third-party beneficiary of these Terms with the right to enforce them:

• These Terms are between you and Paypixl only, not with Apple. Apple is not responsible for the app or its content.
• The license granted is limited to use on Apple-branded devices you own or control, per the Apple Media Services / App Store Terms (Usage Rules).
• Paypixl, not Apple, is solely responsible for the app and for providing any maintenance and support.
• To the extent any warranty applies and the app fails to conform, you may notify Apple for a refund of the purchase price (if any); Apple has no other warranty obligation.
• Paypixl, not Apple, is responsible for addressing product claims, legal/regulatory compliance, and third-party intellectual-property claims relating to the app.
• You represent that you are not located in a U.S.-embargoed country or on a U.S. prohibited-parties list.

16. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service. Sections that by their nature should survive termination (including 9–13, 17–18) survive.

17. Governing law; dispute resolution; arbitration

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules.

Please read this section carefully — it affects your legal rights. Except for small-claims matters and requests for injunctive relief regarding intellectual property, you and Paypixl agree to resolve any dispute arising out of or relating to the Service or these Terms by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. You and Paypixl waive any right to a jury trial and to participate in a class, collective, or representative action. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing support@paypixl.io with your name and account email and the statement that you opt out of arbitration.

18. General

• Changes: We may update these Terms. Material changes will be reflected by the "Last updated" date and, where appropriate, in-app or email notice. Continued use after changes take effect means you accept the updated Terms.
• Severability: If any provision is unenforceable, the rest remains in effect.
• No waiver: Our failure to enforce a provision is not a waiver.
• Assignment: You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
• Entire agreement: These Terms and the Privacy Policy are the entire agreement between you and Paypixl regarding the Service.
